Washington House Bill 1079: In-state Tuition For Undocumented Students

In 2003, Governor Locke signed House Bill 1079 allowing undocumented students to pay instate tuition in the State of Washington.  To be eligible for in-state tuition, a student must meet the following requirements:

  • live in Washington State for three years immediately before receiving a high school diploma,
  • graduate from a Washington State high school,
  • sign the affidavit stating they will file to adjust their status as soon as possible, and
  • acceptance into a public college in Washington.

The Affidavit (in appendix) that undocumented students are required to sign is a confidential statement verifying that he/she qualifies to pay resident tuition, and that he/she will seek legal permanent residency when legally permitted to do so.  If an Affidavit is not provided or available, the 1079 Student should ask a trusted relative, friend, teacher, or counselor to request it from the institution he/she plans to attend. The Affidavit is also available on the Walla Walla Public School’s website under Undocumented Student Information.

To enroll in college a student must go through the following steps:

  1. Complete the admission and scholarship applications from the college or university the student plans to attend.
  2. Fill out and sign the Affidavit. This should be available at any public high school, college or university in the state.
  3. Submit the admission, scholarship applications, and Affidavit to the college/university by the deadline stated by the institution.

NOTE: HB 1079 does not rectify students’ immigration status.

Proyecto de Ley 1079 en Washington: Matrícula Estatal Para Estudiantes Indocumentados

En el 2003, el Gobernador Locke firmó el Proyecto de Ley 1079 el cual permite a los estudiantes indocumentados pagar matrículas estatales en el Estado de Washington. Para ser elegible para la matrícula estatal, el estudiante debe cumplir con los siguientes requisitos:

  • vivir en el Estado de Washington por tres años justo antes de recibir el diploma de la preparatoria (High School),
  • graduarse de una de las escuelas preparatorias del Estado de Washington,
  • firmar una declaración jurada en donde se indica que se entregarán los documentos necesarios para ajustar su estatus legal tan pronto como sea posible, y
  • ser aceptados en un colegio público de Washington.

La Declaración Jurada (anexada) que los estudiantes indocumentados están obligados a firmar es una declaración confidencial que verifica que él / ella califica para pagar la matrícula de residente, y que él / ella va a solicitar la residencia legal permanente cuando se tenga permiso legal para hacerlo. Si una Declaración Jurada no se suministra o no la tiene a su disposición, el estudiante 1079 debe pedirle a un pariente de confianza, amigo, maestro o consejero que la solicite a la institución que él / ella piensa asistir. La declaración jurada también está disponible en el sitio web de las Escuelas Públicas de Walla Walla bajo Información Para Estudiantes Indocumentados.
Para matricularse en el colegio, un estudiante debe seguir los siguientes pasos:

  1. Completar las solicitudes de admisión y de becas de la universidad o colegio al que el estudiante planea asistir.
  2. Llenar y firmar la Declaración Jurada. La cual debe estar disponible en cualquier escuela preparatoria pública, colegio o universidad del estado.
  3. Entregar la solicitud de admisión, solicitudes de becas y la Declaración Jurada al colegio / universidad en los plazos establecidos por la institución.

NOTA: HB 1079 no rectifica el “estado migratorio” del estudiante.
